Asylum

Our firm provides comprehensive representation for political asylum applicants, handling both affirmative cases before asylum offices and defensive cases in immigration courts. We also manage appeals of asylum denials to the Board of Immigration Appeals and the Federal Circuit Courts of Appeals.

To qualify for asylum, applicants must demonstrate a well-founded fear of persecution in their home country or last habitual residence due to their race, religion, political opinion, nationality, or membership in a particular social group. Successful applicants must provide evidence of past persecution or establish a credible fear of future persecution. If the persecution is not carried out by the government, the applicant must prove that the government is unwilling or unable to control the persecuting group.

Asylum applications must be filed within one year of entering the United States or within a reasonable period after the expiration of an authorized stay, typically no later than six months after the expiration. Exceptions to this deadline may apply if extraordinary circumstances or significant changes in country conditions arise, leading to a valid asylum claim. If the one-year filing deadline cannot be met, individuals may still seek withholding of removal or protection under the Convention Against Torture, though these forms of relief require a higher burden of proof.
